Welcome to Ember Academy. By accessing or using our website at enrollember.com and our online training services, you agree to be bound by these Terms of Service.

1. Acceptance of Terms

By creating an account, purchasing a membership, or accessing any content on Ember Academy, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

2. Description of Service

Ember Academy provides online gymnastics training courses, including instructional videos, exercises, and educational content. Our service includes:

  • Access to 7 comprehensive training courses
  • Video demonstrations and tutorials
  • Bi-weekly new content updates
  • Community forum access (for paying members)
  • Progress tracking tools

3. Membership and Subscriptions

3.1 Membership Plans

  • Monthly Membership: $18 per month, billed automatically until cancelled
  • Annual Membership: $200 per year, billed annually until cancelled

3.2 Payment Terms

  • All fees are in U.S. dollars
  • Payment is processed securely through Stripe
  • You authorize us to charge your payment method for all fees
  • If payment fails, we may suspend or terminate your access

3.3 Automatic Renewal

  • Memberships automatically renew unless you cancel before the renewal date
  • You will be charged at the then-current rate unless we notify you otherwise
  • We will send renewal reminders via email

3.4 Cancellation

  • You may cancel your subscription at any time
  • Cancellations take effect at the end of your current billing period
  • You will retain access until the end of the paid period
  • No partial refunds for unused time within a billing period

3.5 Free Trial (if applicable)

  • Free trials, when offered, are available to new members only
  • You must provide payment information to start a trial
  • You will be charged automatically when the trial ends unless you cancel
  • One trial per person/household

4. Refund Policy

Please see our FAQ page for detailed refund information. In general:

  • We offer refunds within 30 days of initial purchase
  • Refund requests must be submitted via email
  • Refunds are issued to the original payment method
  • We reserve the right to deny refunds for abuse of the policy

5. User Accounts

5.1 Account Creation

  • You must be at least 13 years old to create an account
  • Users under 18 require parental consent and supervision
  • You must provide accurate, current information
  • You are responsible for maintaining account security

5.2 Account Sharing

  • Accounts are for individual use only
  • Do not share login credentials
  • One account per person
  • We may terminate accounts for sharing violations

5.3 Account Termination

We reserve the right to suspend or terminate accounts that:

  • Violate these terms
  • Engage in fraudulent activity
  • Share account access
  • Abuse or harass other users or staff

6. Assumption of Risk and Liability Waiver

6.1 Physical Activity Warning

IMPORTANT: Gymnastics and physical training involve inherent risks of injury. By using Ember Academy:

  • You acknowledge that physical exercise carries risk of injury
  • You assume all risks associated with participating in the training
  • You agree to consult with a physician before beginning any exercise program
  • You confirm you are in good physical health and have no conditions that would prevent safe participation

6.2 Supervision of Minors

  • All users under 18 must be supervised by a parent or guardian during training
  • Parents/guardians are responsible for ensuring safe training environments
  • Parents/guardians must ensure proper equipment and space

6.3 Release of Liability

To the fullest extent permitted by law:

  • Ember Academy, its owner, instructors, and affiliates are NOT liable for any injuries, damages, or losses resulting from use of our content
  • You release Ember Academy from all claims related to injury or harm
  • You agree to hold Ember Academy harmless from any third-party claims
  • This includes injuries from improper technique, equipment failure, or environmental factors

6.4 Not a Substitute for Professional Coaching

  • Our content supplements but does not replace in-person coaching
  • We do not provide individualized medical or fitness advice
  • Consult qualified professionals for personalized guidance

7. Intellectual Property Rights

7.1 Ownership

All content on Ember Academy is owned by or licensed to us, including:

  • Videos, images, and graphics
  • Course materials and lesson plans
  • Text, design, and layout
  • Trademarks and branding

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to:

  • Access and view content for personal use only
  • Download materials expressly marked as downloadable
  • This license terminates when your membership ends

7.3 Prohibited Uses

You may NOT:

  • Record, screenshot, or download videos (except where permitted)

  • Update pricing for new members (existing members maintain their rate)

12. Termination

12.3 Effect of Termination

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE LAST 12 MONTHS
  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • THIS INCLUDES DAMAGES FOR INJURY, LOST PROFITS, DATA LOSS, OR SERVICE INTERRUPTION
  • SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY, SO THESE LIMITS MAY NOT APPLY TO YOU

15. Indemnification

You agree to indemnify, defend, and hold harmless Ember Academy and its owner from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the service
  • Your violation of these terms
  • Your violation of any rights of another party
  • Injuries you sustain while using our content

16. Dispute Resolution

16.1 Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law principles.

16.2 Informal Resolution

Before filing a claim, you agree to contact us to attempt informal resolution.

16.3 Arbitration

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, conducted in California.

16.4 Class Action Waiver

You agree to resolve disputes individually, not as part of a class action or representative proceeding.

These terms constitute the entire agreement between you and Ember Academy.

17.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

17.3 No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

You may not transfer your account. We may transfer our rights and obligations.

17.5 Changes to Terms
